The workplace manslaughter laws introduced in Victoria last week could capture workplace practices and actions that are deemed negligent conduct, or fatalities that occur in other jurisdictions, or are the direct cause of a mental illness that leads to death, the State Government has revealed.

Federal Government bans unprotected Quad Bikes

Within 12 months, all new quad bikes sold in Australia will be required to come with a warning label alerting riders to the risk of rollover, display stability test results and meet US or European standards for the performance of components like brakes, suspension, throttles and clutches, Federal Assistant Treasurer Michael Sukkar has announced.

Security Guard awarded $31,618 after “harsh” dismissal for tackling a patient

A hospital security guard dismissed for tackling an absconding patient has filed a successful unfair dismissal claim against a Victorian hospital. The Fair Work Commission (the “Commission”) found that while there was a valid reason for the termination, the outcome of dismissal was harsh given the circumstances. Compensation of over $31,000 was ordered.

Storeperson unable to lift fairly dismissed

An employee’s application for an unfair dismissal remedy has been dismissed by the Fair Work Commission (the “Commission”). The employee was terminated after a period of extended absence because she was unable to fulfil the inherent requirements of her role. She claimed the dismissal was unfair and sought reinstatement.

Cyber Security: what you need to know

Like most organisations, employees receiving attempted phishing emails is part of the daily work cycle at The Victorian Chamber of Commerce and Industry. The Office of the Australian Information Commissioner (OAIC) has recently released its quarterly report, stating that out of the 245 reported data breaches between July and September of this year, 20 per cent were a result of social engineering attacks conducted by cyber criminals through phishing techniques.

Dismissed unfairly by "curt" text message

Two employees who believed their employment had been terminated after receiving a text message from their supervisor saying they would be “missed” and that there was “no work” for them have been awarded compensation. The Fair Work Commission (FWC) found the dismissal was harsh, unjust and unreasonable.
