Visa sponsorship changes for the fast food industry

The federal government has barred fast food chains from sponsoring foreign workers to work in Australia.

The Minister said Australian workers, particularly young Australians, must be given priority.

This decision will not impact current labour agreements however, these companies will not be able to seek a renewal of their labour agreement on expiry or termination. Businesses who believe that a labour agreement is still warranted on the grounds that exceptional circumstances exist can still request a labour agreement.

Companies should be aware that they will need to put forward a very strong case with supporting evidence to demonstrate that:

  • there is in fact a skills shortage in the context of a particular store/position
  • they have reduced their reliance on overseas workers.
