Changes to Victoria's child employment laws

Wage Inspectorate Victoria reminds employers to be aware of Victoria’s updated child employment obligations after it ran a compliance campaign over the school holidays.

Child employment officers focused on retail businesses in shopping centres across Melbourne, visiting 169 businesses in eight shopping centres across four days, with a further 90 required to produce information about workers under the age of 15.

Four businesses were employing children without a permit, with consequences ranging from warnings to further compliance action.

Changes to child employment laws took effect on 1 July 2023.

Wage Inspectorate Victoria says many employers continue to mistakenly believe a child must be 14 and 9 months to work, and that no specific laws apply once they hit that age.

An employer usually needs a licence to employ someone under 15, whether the work is paid or voluntary. Employing a child without a licence is a crime and may be penalised.

Where a licence is granted, a business can employ multiple children under one licence. Licences are free and last for up to 2 years.

Employers must have the written consent of a parent or guardian before a child can start employment, which must be provided to the Wage Inspectorate if requested.

Workers under 15 must be supervised by someone who is at least 18 years old and holds a valid Victorian Working with Children Clearance, unless they are exempt, such as a parent supervising their child.

Parents or guardians don’t need a licence to employ their child in their family business and are exempt from rules.

Children can only be employed for light work, and there are also restrictions on when children can work and for how long.

Wage Inspectorate Victoria says that it will continue to help businesses understand and comply with Victoria’s child employment framework in 2023-24, including the licencing system that makes it easier to hire kids and keep them safe in the workplace.
