Victorian Chamber reviews Closing Loopholes Bill

Members and other stakeholders have an opportunity to view a Victorian Chamber overview of the Fair Work Legislation Amendment (Closing Loopholes) Bill 2023.

The Bill was introduced on Monday 4 September 2023 to Federal Parliament and proposes significant changes to the industrial relations landscape which will impact the way we do business.

Comprising 285 pages with a 521-page explanatory memorandum, the Bill is lengthy and complex.

In a special webinar held on 15 September, the Victorian Chamber’s Workplace Relations team explains the key reform areas, including:

  • Wage theft
  • Labour hire
  • Gig economy
  • Road Transport
  • Workplace delegates rights and protections
  • Family and domestic violence
  • Casual employment
  • Unfair contract terms
  • Industrial manslaughter.

The webinar presents a side-by-side analysis of current Federal (and State) laws and how the proposals would change those positions.

Victorian Chamber General Manager Workplace Relations and Safety Amy Bell reminds that an inquiry will take place on the Bill and is due to report back in February 2024.

“It’s a piece of draft legislation which is not yet in force so we don’t know quite what form it will take or what amendments might apply,” she said.

“But what we do know is it’s really important that we take the time now to understand what’s contemplated and think about what we can do to understand the makeup of a workforce and anticipate how these changes may impact this.

“Until and unless the law is changed, you need to continue to comply with current [legislation].”

The Victorian Chamber has stated that it does not support the current Bill, which is too complex and adds another layer of regulatory burden added costs of doing business. The Chamber proposes further consultation with stakeholders to make amendments before re-introducing the Bill in 2024.
