Business advised of Fair Jobs Code introduction

The Department of Jobs, Precincts and Regions has released new information to help industry prepare for changes to doing business with the Victorian Government

The Victorian Fair Jobs Code was launched on 10 August 2022 as part of the Victorian Government’s procurement and grants framework.

To come into effect from 1 December 2022, the Code will apply to suppliers bidding for applicable goods, services and construction projects or business expansion grants, including:

  • Suppliers bidding for goods, services and construction procurement worth $3 million or more (exclusive of GST)
  • Subcontractors delivering work worth $10 million or more (exclusive of GST) on procurement of $20 million or more (exclusive of GST)
  • Businesses applying for significant business expansion grants of $500,000 or more (exclusive of GST) with a commitment to create jobs.

Application of the Code is not retrospective.

Supplier and business requirements

The Fair Jobs Code introduces two new requirements – a Pre-Assessment Certificate and a Fair Jobs Code Plan.

A Pre-Assessment Certificate is mandatory and confirms compliance with industrial relations and occupational health and safety laws over the preceding three years.

From 1 December 2022, a Certificate must be held before tendering or applying for an applicable contract or grant. Without a certificate, suppliers or businesses will not be able to tender for procurement contracts over $3 million or apply for significant business expansion grants over $500,000 where jobs are a key deliverable, after 1 December.

The application process is free and should take around 30 minutes via the Buying for Victoria website. Certificates are issued by the Department of Jobs, Precincts and Regions, usually within 30 days, and are valid for two years.

While suppliers and businesses do not need to have a specific tender or grant application in progress, those considering applying in 2023 are advised to apply for a Certificate as soon as possible.

For procurement contracts of $20 million or more, or significant business expansion grants of $500,000 or more where new jobs are a key deliverable, a Fair Jobs Code Plan is also required to address how the Fair Jobs Code standards will be met. Construction suppliers must submit a Plan Addendum instead of a Plan which considers other construction procurement commitments.
