Consultation on proposed 2024 WorkCover regulations

Feedback is being sought on upcoming new regulations to support Victoria’s WorkCover scheme, which propose changes around compensation and self-insurance arrangements.

WorkSafe Victoria, in consultation with key stakeholders, has prepared the proposed Workplace Injury Rehabilitation and Compensation (WIRC) Regulations 2024. Key aspects of this will primarily be of interest and impact to members who are self-insured.

The proposed WIRC Regulations will be made under the Workplace Injury Rehabilitation and Compensation Act 2013 (WIRC Act), which addresses what happens when a Victorian worker is injured or killed at work.

These Regulations are separate to the changes proposed by the WorkCover Scheme Modernisation Bill, which proposes significant changes to the WorkCover scheme and will have broad reach and application. The Victorian Chamber continues to advocate for our member concerns around the WorkCover scheme.

Proposed WIRC amendments

The following key changes have been incorporated into the proposed WIRC Regulations:

  • the percentages deemed not remuneration for certain classes of contractors have been updated
  • the statement of identity and medical certificate forms for injured workers that live overseas have been taken out of the regulations and are proposed to instead be available on WorkSafe’s website
  • the formula for determining self-insurer contributions has been simplified and from 1 January 2025 contributions will be calculated annually instead of quarterly
  • from 1 January 2025, the existing discount on common costs will be removed from the self-insurer contributions formula.

WorkSafe says several minor changes have also been incorporated to help simplify and modernise the language so that the regulations are easier to read and understand.

A detailed summary of changes and frequently asked questions are available on the public consultation website, which also outlines how businesses and can make submissions. Consultation ends on 13 February 2024.

WorkSafe will consider all submissions and make further amendments to the proposed WIRC Regulations where appropriate.

The new regulations are set to apply in May 2024, replacing the existing regulations which will expire on 27 May 2024.
